Common Sense: Not So Common – CCAT April 28, 2022 Listen and Learn: All the Stories to Be told

I get to speak on a topic I thought I’d never hear addressed in any legal academic setting, let alone at a “Symposium”. Have to confess, I am very excited about this unique opportunity to speak my mind!

I was reminded by the kind organizers of this extraordinary event that last October, I tweeted out some frustration with administrative tribunals’ proceedings. This is what I said:

My Tweet reportedly served as the genesis for an idea to include a panel on Common Sense at the Council of Canadian Administrative Tribunals (CCAT)’s 2022 Symposium “Listen and Learn: All the Stories to be Told” happening virtually on April 28, 2022.

I am very excited to be among the speakers on this panel. Here is the Description of the Session:

Challenge the notion of common sense with a view to better understanding and applying common sense in adjudicative settings. Is common sense “sound and prudent judgment based on a simple perception of the situation or facts” or “a grab-bag of unjustified beliefs and incoherent intuitions”? This session will explore common sense from a diversity of perspectives with a view to identifying opportunities to improve decision making and adjudicative processes.
