In this Episode of She Cares, WiCCD’s Secretary Anita Szigeti hosts Nova Scotia lawyer Hanna Garson and Ontario lawyer Kate Mitchell to delve deeper into habeas corpus applications.

Kate Mitchell is a doctoral candidate at the University of Toronto and a Trudeau Scholar. Her research focuses on developing a framework to better protect prisoners’ rights. She also serves on the executive of the Canadian Prison Law Association.

Hanna Garson is a criminal defence lawyer and prison law litigator in Nova Scotia, working to support and protect the rights of accused persons and individuals in custody. Her work is strengthened by the guidance, collaboration, and advocacy of communities such as PATH Legal, East Coast Prison Justice Society, and the Canadian Prison Law Association.

In this Episode, Hanna and Kate discuss the evolving case law regarding habeas corpus applications. Habeas corpus is a powerful tool that is meant to be available to anyone experiencing a deprivation of liberty who questions the legality of their detention or restriction. It is often, though not exclusively, used by prisoners in litigating issues arising in the context of their detention, such as security levels. The Supreme Court of Canada has recently granted leave in Diggs v. AG (Nova Scotia) which considers when habeas corpus is available and what kind of remedies may be sought and granted. Both Hanna and Kate are experts on the law of habeas corpus and discuss the implications of the Diggs case coming up at the SCC.
